What the rules mean

Start with facts and preserved evidence

Federal and California rules may apply to unwanted marketing texts or calls depending on consent, the sender, technology, content, timing, opt-out activity, and other facts. A screenshot alone does not establish a legal claim, and Advoclead does not provide legal advice.

Evidence to preserve

Keep screenshots showing the sender or short code, full message, date, and time.

Save the message where you asked the sender to stop and any messages received afterward.

Do not crop away the sender, timestamp, opt-out language, or surrounding conversation.

Record whether you know the company name; supporting evidence may still be reviewed when the name is unclear.

Questions that help organize screening

  1. 1Did you receive marketing or solicitation texts?
  2. 2Did you ask the sender to stop or use an opt-out command?
  3. 3Did messages continue after that request?
  4. 4Do screenshots or the original message thread still exist?

Frequently asked questions

What should a California text-message screenshot include?

Keep the sender or short code, the complete text, date, time, opt-out wording, your stop request, and later messages. Preserve the original thread when possible.

Can screening continue if I do not know the sender's company name?

The configured Advocates National screening can continue when supporting message evidence exists even if the company name is not yet known. The firm decides whether further investigation is appropriate.

Does submitting information create an attorney-client relationship?

No. Submission requests screening only. Representation begins only if a law firm separately agrees to represent you and both sides complete the firm's required agreement process.

Educational information only. Advoclead is not a law firm. A participating independent firm makes every legal and representation decision.
