Important
Advoclead is not a law firm and does not provide legal advice. This page provides educational resources and a route to request screening where an approved participating firm is identified.
What the rules mean
Start with facts and preserved evidence
Florida consumers may have protections under the federal Fair Debt Collection Practices Act and Florida's Consumer Collection Practices Act. Whether either law applies depends on the collector, the communication, the debt, timing, and other facts. Advoclead does not make legal conclusions.
Evidence to preserve
Save letters, emails, text messages, and account notices without editing or deleting them.
Keep screenshots of call history with dates, times, phone numbers, and voicemail indicators.
Write down the collector or creditor name, the amount discussed, and what the caller said.
If evidence exists but is not available during screening, say that it can be provided later.
Questions that help organize screening
- 1Was the communication about collecting a consumer debt?
- 2Who contacted you, and did they identify the company?
- 3Do messages, recordings, letters, or call logs still exist?
- 4When did the most recent communication occur?
Frequently asked questions
What evidence should I save about Florida debt collection calls?
Save call logs, voicemails, text messages, letters, emails, account notices, and your notes about what was said. Keep original files when possible and record dates and times.
What if my evidence exists but I cannot open it during screening?
Explain that the evidence still exists and can be supplied later. Bernheim Kelley's configured screening distinguishes evidence that is temporarily unavailable from evidence that no longer exists or cannot be provided.
Is Advoclead a law firm?
No. Advoclead is a marketing, intake-technology, and lead-management company. A participating independent law firm makes every legal and representation decision.
